In these days of increasingly competitive employment market, businesses’ contracts with their key personnel are more and more valuable.  But restrictive covenants such as non-competes and non-solicitation clauses are not easily enforced.

Recently, a large contractor retained Rathje Woodward to file a Complaint and seek a Temporary Restraining Order following the resignation of a key employee who joined a competitor. Shortly after filing the Complaint and Motion for Temporary Restraining Order, DuPage County Circuit Court Judge Robert Kleeman heard oral arguments and granted the Motion for Temporary Restraining Order, which bars the former employee’s continued employment with the competitor and enjoins the former employee and the competitor from soliciting the client’s customers and employees.  Rathje’s litigation team consisted of Charles L.
