Michael L. Wojciak has a diverse practice representing individuals, families and companies in litigation, estate planning, estate administration and corporate matters. Throughout his career, Mike represented both plaintiffs and defendants in commercial litigation, personal injury, and tort related matters in both state and federal courts. He brings a unique perspective to his practice groups having represented parties on both sides of the aisle during all phases of litigation and transactions.
In particular, Mike has extensive experience in complex personal injury and wrongful death cases involving commercial motor carriers. Mike’s familiarity with various transportation sectors is a valuable asset in investigating claims, assessing liability, developing a strategy, and advising clients as to their risks and interests. His litigation exposure also includes premises liability, property damage, and cargo loss cases. Mike also previously represented plaintiffs in motor vehicle accidents, slips and falls, medical malpractice, nursing home negligence, and workers’ compensation claims.
Through his litigation experience, Mike realized the importance of estate planning for both individuals and businesses. Mike notes that proper estate planning allows an individual to fulfill their wishes upon their passing as well as the additional benefits of caring for minor children, avoiding the expense and time of the probate court process, minimizing family disputes, and managing estate taxes. Over the years, Mike has assisted clients with their estate plans, but also used his litigation experience to handle estate administration, trust and estate litigation, and guardianship proceedings.
As part of his estate planning work, Mike also represents closely held businesses. He is suited to handle the formation and structuring of small businesses on a transactional level. In the event partnership and contract disputes arise, he is well suited to handle such matters given his litigation background.
Mike and his wife live in Wheaton with their two labs, Hershey and Nilla. Mike is a proud Iowa Hawkeye and diehard Chicago Blackhawks fan.
